Just Released! Procedural Lapses Prompted Claim of DBE Fraud

The BART Office of the Inspector General (OIG) has published a new report detailing an investigation into a DBE fraud complaint tied to a $19.9 million construction contract.

We found that a failure to process a required change order led to undocumented changes in DBE participation. While the preponderance of evidence did not support intentional fraud, the lapse in procedure created confusion, undermined compliance, and contributed to the appearance of DBE fraud.

No recommendations are issued in this report, but our upcoming audit on construction contract change orders will address broader systemic issues.
